These Terms and Conditions govern the use of all services provided by LinguaElite Ltd ("the Company," "we," "us," "our"), a company registered in England and Wales (Company No. 14735524). By booking a trial class, purchasing a class package, or using any of our services, you agree to these Terms and Conditions.
1. Description of Services
LinguaElite provides online English tutoring services to students worldwide. Classes are conducted via Zoom by qualified, native English-speaking teachers. Services include General English, Conversation, Business English, IELTS Preparation, Kids and Teens English, Exam Preparation, and related educational products such as essay marking and digital resources.
2. Pricing and Payment
All class packages and services must be paid for in advance before classes begin.
Accepted payment methods: Card payment (Visa, Mastercard, American Express), Apple Pay, Google Pay, Alipay, WeChat Pay, and Klarna (available in selected regions), processed securely via Stripe.
Currencies: Pricing is displayed in GBP. Selected services may also display pricing in CNH (RMB), HKD, ZAR, INR, or NGN for students in specific markets. The currency displayed at the time of purchase is the currency charged.
Trial classes: Trial classes are 25 minutes in duration and are charged at £3.75 (or the equivalent in local currency where applicable). Trial classes are limited to one per student and are non-transferable.
Class packages: Packages are available in 10-class and 20-class options. Larger packages are available on request. Payment is required in full before classes begin.
IELTS Strategy Intensive: This course is priced separately and consists of 6 sessions. Payment is required in full before the first session. The 2:1 option is available for couples, family members, or colleagues and may be paid as a single combined payment or as two individual payments.
Essay marking add-ons: Essay marking is available as a 3-essay or 5-essay bundle. Payment is required before submission of essays for marking.
3. Package Validity
All class packages are valid for 12 months from the date of purchase. Unused classes that fall outside this 12-month period will expire and are not eligible for a refund. If you anticipate being unable to use your classes within 12 months, please contact us to discuss your options before the expiry date.
4. Scheduling
Classes are scheduled by mutual agreement between the student and the Company. Students should communicate their preferred days and times via the booking form, email (admin@linguaelite.com), or WhatsApp. The Company will confirm class times via email or WhatsApp.
The Company matches each student with a teacher within 48 hours of receiving a completed booking form. While we make every effort to accommodate scheduling preferences, class times are subject to teacher availability.
5. Cancellations and Rescheduling
Student cancellations:
If a student needs to cancel or reschedule a class, they must provide at least 24 hours' notice via email or WhatsApp. Classes cancelled with at least 24 hours' notice will be rescheduled at a mutually convenient time. Classes cancelled with less than 24 hours' notice, or classes where the student does not attend without notice, will be forfeited. The class fee will not be refunded or credited.
Teacher cancellations:
If a teacher cancels a class for any reason, the class will be rescheduled at a time convenient for both the student and the teacher. If rescheduling is not possible, the class will be credited back to the student's package.
Company cancellations:
The Company reserves the right to cancel classes in exceptional circumstances (such as technical failures or teacher emergencies). In such cases, affected classes will be rescheduled or credited.
6. Refunds
Trial classes: Trial class fees are non-refundable.
Class packages: If a student wishes to discontinue classes, they may request a refund for unused classes within their package. Refunds are calculated based on the number of classes used, charged at the full single-class rate (£16.50 per class), with the difference refunded. This means students who purchased a discounted package will receive a refund based on the discounted total minus the full-rate cost of classes already taken.
IELTS Strategy Intensive: Refund requests made before the first session will receive a full refund. After the first session, no refunds are available. This is because the course is structured as an integrated programme and the value of each session depends on the sequence as a whole.
Essay marking add-ons: Refunds are available for unmarked essays only. Once an essay has been marked and returned, the fee for that essay is non-refundable.
Processing: All refunds are processed via Stripe to the original payment method within 14 business days of the approved request. To request a refund, contact us at admin@linguaelite.com.
7. Homework and Class Preparation
Any homework, essays, or specific materials that a student wants the teacher to review during a class must be submitted to the teacher at least 24 hours before the scheduled class. Materials submitted after this deadline may not be reviewed during the session.
For the IELTS Strategy Intensive, essay submissions for live review must be submitted via Google Docs at least 24 hours before the relevant session. Essay marking add-ons (marked outside of class) should be submitted via Google Docs and will be returned within 5 business days.
8. Student Work and AI Policy
Students are expected to submit their own original work when completing homework, essays, and assignments. The use of AI writing tools (such as ChatGPT, Grammarly AI, or similar) to generate or substantially rewrite homework submissions undermines the learning process and the accuracy of the teacher's feedback.
If a teacher suspects that submitted work has been generated or substantially assisted by AI, they may raise this with the student and request that the work be redone. This policy exists to protect the integrity of the student's learning, not as a punitive measure.
9. Teacher Assignment
The Company matches each student with a teacher based on the student's goals, level, age, and scheduling needs. Students work with the same teacher throughout their course of study.
In exceptional circumstances (such as teacher illness, extended leave, or schedule changes), the Company may assign a substitute teacher to ensure continuity of lessons. If a substitute is necessary, the Company will inform the student in advance and make every effort to ensure a smooth transition.
If a student feels that their assigned teacher is not the right fit, they may contact the Company to request a change. We will reassign the student to a different teacher at no additional cost.
10. Conduct and Behaviour
Both students and teachers are expected to maintain a respectful and professional environment during classes. This includes punctuality, appropriate language, and appropriate dress.
For students under 18, parents or legal guardians are responsible for ensuring a safe and appropriate learning environment. Parents may be present during lessons but should avoid interrupting the class.
The Company reserves the right to suspend or terminate services if a student (or parent/guardian) engages in behaviour that is disruptive, disrespectful, or inappropriate. In cases of termination for conduct reasons, a refund will be provided for unused classes only.
11. Recording and Screenshots
Students may not record, screenshot, photograph, or stream any part of a live class without the prior written consent of both the teacher and the Company. This policy exists to protect the privacy of teachers and, in 2:1 sessions, other students.
Teachers may record classes for quality assurance or training purposes only with the student's prior consent.
12. Intellectual Property
All teaching materials, lesson content, curricula, worksheets, slide decks, and resources provided by LinguaElite are the intellectual property of the Company and are provided for the student's personal educational use only. They may not be copied, shared, distributed, resold, or used for commercial purposes without prior written permission from the Company.
13. Technology and Internet
Students are responsible for ensuring they have a stable internet connection, a functional device (computer, tablet, or phone), and working audio and video equipment for their classes.
The Company is not responsible for missed classes, interruptions, or reduced lesson quality caused by technical issues on the student's side. If a technical failure on the Company's side (such as a Zoom outage) prevents a class from taking place, the class will be rescheduled or credited.
14. Testimonials and Feedback
The Company may request feedback or testimonials from students or their parents/guardians. With the student's or parent's consent, the Company may use this feedback on its website, social media, and marketing materials. Testimonials may be attributed with a first name and country, or anonymised, depending on the student's preference.
Students and parents may withdraw their consent for the use of their testimonial at any time by contacting admin@linguaelite.com.
15. Communication
Official communication between the Company and its students takes place via email (admin@linguaelite.com) and WhatsApp. The Company is not responsible for messages sent to channels other than these, including personal email addresses or social media accounts, unless explicitly agreed otherwise.
Class-related communications (scheduling, cancellations, homework submissions) should be directed to admin@linguaelite.com or to the teacher's designated email address or WhatsApp number.
16. Limitation of Liability
The Company provides educational tutoring services and does not guarantee specific educational outcomes, exam results, or band scores. While we are committed to delivering high-quality instruction, results depend on the student's starting level, effort, practice, and factors outside our control.
The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use of its services. Our total liability for any claim arising from our services is limited to the total amount paid by the student for the specific service in question.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
17. Dispute Resolution
In the event of a dispute, the parties agree to attempt resolution through the following process:

Informal resolution: Contact us at admin@linguaelite.com to discuss your concern. We aim to resolve all issues within 14 business days.

Mediation: If informal resolution is not successful, either party may propose mediation through a mutually agreed mediator.

Legal proceedings: If mediation does not resolve the dispute, either party may pursue legal proceedings in accordance with the governing law below.
18. Changes to These Terms
The Company reserves the right to modify these Terms and Conditions at any time. When changes are made, we will update the "Last updated" date at the top of this page. For significant changes, we will notify affected students via email. Continued use of our services after changes are published constitutes acceptance of the revised Terms.
19. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
